General Terms and Conditions of Sale

1. Scope

These General Terms and Conditions of Sale (GTCS) govern all sales of services by LenoIT, operating the Cloud-PBS service. They apply to both business customers and consumer customers.

2. Services

Cloud-PBS offers the following services:

  • Managed Proxmox Backup Server instances
  • Proxmox datacenter management service
  • Offline backup copy service
  • Managed restore service

3. Pricing

  • Prices are displayed on our website and may change.
  • Prices are stated in Euros and exclude tax; applicable VAT is added where relevant.
  • A pricing change does not affect billing cycles already in progress.

4. Payment

  • Payment is due upon subscription or renewal.
  • Payments are processed by our provider Stripe. We accept credit cards (Visa, Mastercard, American Express) and SEPA direct debit.
  • Invoices are available from the dashboard.

5. Free trial

  • New accounts receive a 7-day free trial.
  • A valid payment method is required to start the trial.
  • At the end of the trial, a subscription is required to keep using the service.
  • The data of a trial account is deleted 30 days after the trial expires.

6. Subscription and renewal

  • Monthly subscriptions renew automatically each month.
  • Annual subscriptions renew automatically each year.
  • You can cancel at any time from the dashboard.

7. Cancellation and refund

  • Monthly subscription: can be cancelled at any time, effective at the end of the current billing period.
  • Annual subscription: can be cancelled at any time, effective at the end of the current annual period.
  • No pro-rata refund is made for a period already started.

8. Right of withdrawal

In accordance with the French Consumer Code, a consumer customer has 14 days from subscription to exercise their right of withdrawal, without having to give a reason.

If a consumer customer asks for the service to start before the end of that period, they make an express request to that effect. They acknowledge that their right of withdrawal ends once the service has been fully performed, and that in the event of withdrawal before that point, the amount due corresponds to the service already provided.

9. Return of data

Upon cancellation, your backups remain accessible for 30 days, so that you can retrieve them before their permanent deletion. During that period you can restore or export your data at any time. After that period, the datastore’s data is permanently deleted and can no longer be recovered.

10. Service level

We aim for 99.9% availability for managed services. This is a best-efforts objective: no automatic compensation is due if it is not met. Planned maintenance windows are communicated in advance and are not counted against this objective.

11. Liability

Our liability is limited to the amount paid for the service during the 12 months preceding the triggering event. We are not liable for data loss resulting from user error, the loss of an encryption key, or an event of force majeure. These limitations apply to the extent permitted by applicable law and do not restrict the rights granted to consumer customers by law.

12. Consumer mediation

A consumer customer may use, free of charge, a consumer mediator for the amicable resolution of a dispute. Competent mediator: [consumer mediator to be designated by LenoIT].

13. Governing law

These GTCS are governed by French law. Any dispute falls within the jurisdiction of the French courts, subject to the protective rules applicable to consumer customers.
