General Terms and Conditions of Sale

1. Introduction

Welcome to Cloud-PBS. These General Terms and Conditions of Sale (GTCS) govern the sale of our cloud backup services for Proxmox VE servers. By subscribing to our services, you agree to these terms in their entirety.

2. Services

2.1 Description of Services

Cloud-PBS offers secure and scalable cloud backup solutions for Proxmox VE servers, including storage synchronization and object storage options.

2.2 Plans and Subscriptions

We offer various service plans, including basic storage options and corporate plans. Each plan includes specific features detailed on our website.

3. Pricing and Payment

3.1 Pricing

Service prices are indicated in euros, all taxes included (TTC). Prices may be changed without notice, changes could affect ongoing subscriptions after a 3 months delay starting from announcement.

3.2 Payment Terms

Service payments are made by credit card or other accepted payment methods, with monthly billing, depending on the chosen plan.

3.3 Invoicing

A detailed invoice will be sent by email at each subscription renewal. It is the client’s responsibility to ensure that payment information is up to date.

4. Delivery of Services

4.1 Service Activation

After subscription and payment receipt, backup services will be activated within 24 hours.

4.2 Access to Services

Clients will receive the necessary information to access their services through an email and the Cloud-PBS documentation.

5. Refund Policy

5.1 Withdrawal

Clients have a period of 14 days from the subscription date to exercise their right of withdrawal and request a full refund.
If the clients are trying the solution through a 7 days free trial, the withdrawal period starts at the beginning of trial.

5.2 Refund Conditions

Refunds will be made subject to non-use of the services during the withdrawal period. No refund requests will be accepted after this period.

5.2 Cancellation

After the first 14 days, all months are due. You can cancel your subscription at any time, free of charge, by using our payment platform or by sending an e-mail directly via this form.

6. Client Obligations

6.1 Compliance

Clients must use Cloud-PBS services in accordance with applicable laws and regulations and not for illegal or unauthorized purposes.

6.2 Security of Credentials

Clients are responsible for the security of their login credentials and must immediately notify Cloud-PBS in case of unauthorized use.

7. Warranty and Liability

7.1 Warranty

Cloud-PBS undertakes to provide services that comply with their description and of satisfactory quality.

7.2 Limitation of Liability

Cloud-PBS cannot be held liable for data loss or service interruptions due to causes beyond our control, including cyberattacks, hardware failures, or natural disasters.

8. Dispute Resolution

8.1 Applicable Law

These GTCS are subject to French law.

8.2 Competent Jurisdiction

Any dispute relating to the interpretation or execution of these GTCS will be subject to the exclusive jurisdiction of the French courts.

9. Modification of GTCS

Cloud-PBS reserves the right to modify these GTCS at any time. Changes will apply as soon as they are published on our website. Clients will be informed of any substantial changes by email.
